Rental Permit Instructions and Information

OBTAINING A RENTAL PERMIT 

The Town of Huntington requires a rental permit for all one and two-family homes, condos, townhouses, apartment complexes, multiple residencies and mixed use occupancy buildings which are rented out.These permits are not applicable to dwellings with legal, accessory apartment permits, as these special use permits have their own rules, regulations and requirements. Rental permits are not required  for rental properties when:

  • The owner lives on the premises (note: accessory apartment permits are special use permits, and do not apply to this section of code)
  • The owner's immediate family lives on the premises
  • There is a homeowner's association on site
  • There is a property management office on site that is accessible to tenants 

If you are an owner who wishes to rent or your circumstances require a rental permit, please follow the instructions below for an initial application.


HAVE AN INSPECTION CONDUCTED

When applying for a rental permit, you have the choice of a town inspection, performed by a Town of Huntington Code Enforcement Official, or you may hire your own licensed professional. If you choose to hire your own professional, they must be one of the following:

  • A Licensed Professional Engineer
  •  A Registered Architect
  • A New York State Certified Code Enforcement Official

If you choose to have a Town of Huntington inspection, please call the Rental Division at 631-351-3009 to schedule your inspection.

*Inspections are held Monday through Friday with the following timeframes:

  • Morning: 9:30AM-12:30PM
  • Afternoon: 12:30PM - 3:30PM
  • Evening: 3:30PM - 7:00PM

SHORT TERM RENTAL PERMITS

A short-term rental property can be comprised of dwelling unit(s), a room, or a group of rooms legally established within one or two family residences that are owner-occupied, including one-family or one family with a valid accessory dwelling unit permit. A short-term rental permit can only be issued to a property that is advertised for lease or rent for a period of less than thirty (30) days.

§160-48 The Town of Huntington requires short-term rentals to be rented or leased for a period of less than thirty (30) consecutive days and no more than ninety (90) days per calendar year, and where no meals are served.

§160-48 The term "short-term rental" does not include mixed-use buildings, multiple dwelling buildings, dormitories, hotel or motel rooms, bed and breakfast inns, or boarding or lodging houses.

An example of a short-term rental property is a property that is offered for lease or rent on a short-term rental website, including but not limited to Airbnb, HomeAway, VRBO and similar websites.

  • New Rental Application $75.00
  • Rental Renewal Application $25.00
  • Rental Permit Fee $475.00 (once an inspection is passed)
  • New Short Term Rental Application and Permit Fee $50.00
  • Short Term Renewal Application and Permit Fee $25.00

All fees are non-refundable. Acceptable payments: All credit cards, personal checks, bank certified checks, and money orders. All checks/money orders should be made payable to the Town of Huntington

 

RENTAL PERMIT FAQS

What does the application process entail?

Owners submit a new application or renewal paperwork along with the application fee. They then call the office to schedule a rental property inspection or submit a private inspection (see Licensed Professional’s Rental Inspection Report) . Once the inspection is completed and the permit fee is processed, the permit will be issued.

How long is my permit valid for?

Rental Permits are non-transferrable and valid for two (2) years. Short Term Rental Permits are valid for (1) year.

Do I need a permit to advertise for rent?

Yes. You are required to display the permit number on all advertisements.

My permit is about to expire and I would like to renew, will I receive a reminder notice?

Renewal Notices are mailed out to the owners approx. two (2) months prior to the permit expiring. Notices are mailed out to the owner’s current mailing address on file. It is the owner’s responsibility to notify the Rental Division if a change of address occurs or if a renewal notice was not received.

I do not wish to renew my rental permit. What do I do?

Please call the Rental Division Office 631-351-3009.

Are rental permits transferable to a new owner?

No. Once a deed change is made, a new rental application must be submitted.

If I purchase a property with a current rental permit, can I use their valid active permit?

No. A rental permit is not transferrable to a new owner. The new owner would need to apply.

Who do I make the payment out to?

Town of Huntington

Does a rental permit affect your taxes?

No. But you cannot claim the Star Exemption on a rental property since it is not owner occupied.

How long can I lease a short term rental?

Short Term Rentals can be offered for lease or rent for a period of less than thirty (30) days and no more than ninety (90) days per calendar year.

How many bedrooms can I rent or lease in a short term rental?

No more than two (2) bedrooms within a dwelling.
