Accessory Dwelling Unit Bureau

The Accessory Dwelling Unit Bureau processes permits for Accessory Dwelling Units ("ADU") also known as Accessory Apartments, oversees permit renewals and transfer of permits, schedules inspections, and aids the Town of Huntington Code Enforcement Officials upholding town code.

Accessory Dwelling Unit Permits

The Town of Huntington requires Accessory Dwelling Unit Permits in owner occupied single-family dwellings. This special issued permit requires permission from the Town of Huntington. This means if an owner of the property wishes to add a second kitchen/unit to their dwelling, permission from the Town of Huntington is required. The process to obtain permission and then the initial permit starts with an application. 

A permit is required for an ADU regardless if the purpose of the ADU is for family, to rent, or for the owner.

As of July 16, 2019 the Accessory Dwelling Unit Bureau no longer accepts BASEMENT/CELLAR OR ATTIC APARTMENT APPLICATIONS.



Transfer Permits

If a property with an Accessory Dwelling Unit Permit is for sale or sold to a new owner, the permit may be transferred to the purchaser of the property, provided the purchaser executes and submits to the Accessory Dwelling Unit Bureau within ninety (90) days of the transfer of title. Non-Owner Occupied Accessory Dwelling Unit Permits must be transferred to Owner Occupied Accessory Dwelling Unit Permits. If the new owner of the property wishes to no longer have the ADU, then the owner must call the office to schedule a removal inspection. 


ALL VALID PERMIT NUMBERS MUST BE POSTED ON ALL ADVERTISMENTS.

Accessory Apartment/Dwelling Unit FAQs

What is an accessory apartment/accessory dwelling unit?

It is a special use/temporary permit granted with permission from the Town of Huntington. This permit is renewed annually.

What type of property may apply for an accessory apartment/accessory dwelling unit permit?

Owner-occupied single family dwellings only.

As the homeowner, do I have to live there?

Yes. The property must be your primary residence and must remain owner-occupied (an owner on the deed must use this property as their primary residence).

What are the requirements for applying for an accessory apartment/accessory dwelling unit permit?

The property must be owner occupied (someone on the deed must reside at the dwelling, the property must be their primary residence) and the property/deed must be in the name of an individual (not in company name). The dwelling must have a certificate of occupancy for at least three years prior to the date of your application.

The habitable space/living space of the apartment cannot be less than 300 sq. feet or more than 650 sq. feet (measurement should not include the bathroom(s), closet(s), hallway(s) or stairway(s).

The accessory apartment/accessory dwelling unit may be no more than two bedrooms.

The accessory apartment/accessory dwelling unit may not be contained in a detached structure.

A minimum of three (3) unobstructed off street parking spaces are required. The tenants of the apartment are required to park off street when the vehicles are not in use.

You will need to provide the following documentation:

  • a. A copy of a survey and the dimensions of the driveway
  • b. The application signed and notarized;
  • c. Floor plans of the entire dwelling, showing the proposed accessory apartment/accessory dwelling unit; with measurements of all rooms, windows and the square footage of the apartment and the main dwelling;
  • d. Copy of the recorded deed;
  • e. Copy of owner(s) driver’s license;
  • f. Pictures of each side of the outside of the dwelling and one of the driveway from the street.

Once the above documentation has been received a hearing date will be scheduled and you will be given further instructions. An inspection is required of the entire dwelling and property.

What happens after the hearing?

You will be given a copy of the resolution from the hearing and checklist of items that need to be addressed by you. This may include obtaining a plumbing permit for the apartment kitchen, sink, and/or stove if gas; installing 5/8” sheetrock in the furnace room and all walls or ceiling where the apartment meets the dwelling; a certificate of occupancy from the Building Department for a finished basement, garage conversion or interior alterations, etc.

Do I need a permit to advertise for rent?

Yes. You are required to display the permit number and expiration date on all advertisements.

How much does the permit cost?

The initial permit application fee is $350, unless there is a violation on the property, in which case the application fee is $1,000. A renewal application fee is $550 annually; unless you are a senior in which case the renewal fee will be $350 annually.

How long is the permit valid?

The permit is valid for 2 years.

What is the renewal process?

You will be mailed the renewal notice and an invoice approximately one month prior to the expiration date. An annual inspection is required and an updated application submitted each renewal. A renewal application fee is $550 annually; unless you are a senior in which case the renewal fee will be $350 annually.

What if the apartment is not being rented/occupied?

Whether the apartment is vacant or occupied is not a factor, neither is it a factor if the occupant is a family member. The permit is a special use permit granted by the town.

What if I don’t want the accessory apartment/accessory dwelling unit any longer?

You would need to call the town to learn the requirements of the removal of the accessory apartment and to schedule a removal inspection.

If I purchase a property with a current accessory apartment/accessory dwelling unit permit, can I use their permit?

No, but the accessory apartment/accessory dwelling unit permit is transferrable to you. This transfer should be done within 90 days after closing. The transfer fee will be either $250 or $500 depending on the previous type of permit. You will need to submit the following:

  • a. an application, signed and notarized by all owners;
  • b. a letter of intent;
  • c. copy of each owner’s driver’s license or government ID;
  • d. two proofs of residency (two bills or statements in your name to the property address);
  • e. photograph of each side of the outside of the dwelling and one of the driveway from the street;
  • f. a copy of the recorded deed (or if the recorded deed has not yet been received a copy of the signed Indenture of Deed from closing); and
  • g. an inspection will need to be scheduled of the entire dwelling.
What about parking?
