Step 3: Complaint Resolution Procedure |
A) Complaint Resolved |
|
At your meeting you and the ADA Officer resolve your complaint. The ADA Officer will, in writing, mail you an agreement that contains: |
• Description of your complaint
• Summary of the facts
• Description of the resolution agreed to
• Timeframe for implementing the resolution
• A statement of the Town’s assurance to comply with the specific terms
|
You will be asked to sign a copy of the agreement and return it to the ADA Officer. |
B) Complaint Not Resolved |
|
At your meeting, if you and the ADA Officer cannot resolve your complaint, the ADA Officer will, in writing, mail you a Notice of Non-Resolution that contains: |
• Description of your complaint
• Summary of any proposed resolution
• Statement addressing the issues that could not be resolved
|
If your complaint is not resolved, you may request a review by the New York State Office of Civil Rights (NYSOCR). |

File a request for review with NYSOCR within 10-business days after you receive your Notice of Non-Resolution from the town’s ADA Officer. Send a copies of your original complaint and Non-Resolution Notice to: |

Important Notes
A. ADA Title I Employment Complaints: ADA Title I addresses disability discrimination related to employment issues, including job application procedures, employment qualification standards, employment testing, hiring, advancement, discharge, employee compensation, job training, and other terms, conditions, and privileges of employment. Please do not use the ADA Title II complaint form and procedure to attempt to resolve employment issues.
B. No Waiver: This policy and complaint procedure is not a waiver of immunity of the Town of Huntington under the Constitution of the United States.
